General Disclaimer

Wiki Duniya (“the Platform”) is a self-service digital platform that enables individuals and organizations to create and manage their own public profile pages. All content published on Wiki Duniya, including but not limited to text, images, logos, videos, links, and other materials (“User Content”), is submitted solely by users of the Platform.

Wiki Duniya does not verify, endorse, or guarantee the accuracy, completeness, legality, or reliability of any User Content. The views and opinions expressed in User Content are those of the respective users and do not reflect the views or policies of Wiki Duniya or its affiliates.

User Responsibility

Users of the Platform are solely responsible for the User Content they submit. Users must ensure that their submissions:

  • Comply with all applicable laws and regulations in India.
  • Do not infringe the intellectual property, privacy, or other rights of any third party.
  • Are not obscene, pornographic, defamatory, fraudulent, hateful, threatening, or otherwise illegal.
  • Do not promote violence, terrorism, discrimination, or hatred against any individual or group.

Wiki Duniya reserves the right, but is not obligated, to monitor, review, edit, or remove any User Content that it deems, in its sole discretion, to be inappropriate, unlawful, or in violation of these terms.

Safe Harbour Protection under Indian Law

Pursuant to Section 79 of the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules”), Wiki Duniya acts as an intermediary facilitating the hosting of User Content provided by third parties.

Under these provisions:

  • Wiki Duniya does not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in the transmission.
  • Wiki Duniya will not be held liable for any third-party User Content hosted on the Platform provided that:
    • Wiki Duniya does not have actual knowledge of unlawful content, or
    • Upon obtaining such knowledge or receiving a court order or government notice, Wiki Duniya acts expeditiously, and in any event, within 36 hours, to disable access to or remove such unlawful content.

Reporting and Removal of Unlawful Content

Users and third parties can report any User Content they believe violates applicable laws or Wiki Duniya’s policies through the designated “Report This Page” feature or by contacting the Platform’s designated Grievance Officer via the Legal Request Form.

Upon receiving valid complaints or legal orders regarding unlawful User Content, Wiki Duniya will:

  • Promptly investigate the complaint.
  • Take necessary action to remove or disable access to the offending content within 36 hours.
  • Maintain a record of complaints and actions taken as per IT Rules.

Limitation of Liability

To the fullest extent permitted by law, Wiki Duniya expressly disclaims any liability for damages arising out of or in connection with the use or inability to use the Platform or reliance on User Content.

Wiki Duniya makes no warranties, express or implied, about the availability, accuracy, reliability, or suitability of the Platform or the User Content for any particular purpose.

Changes to this Disclaimer

Wiki Duniya reserves the right to update or modify this Disclaimer and Safe Harbour Clause at any time. Changes will be effective immediately upon posting on the Platform. Users are encouraged to review this page regularly.
